Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Fleeticc governing your access to and use of our website, mobile applications, GPS vehicle tracking services, and related features (collectively, the "Services"). By creating an account, signing in, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

Overview

Fleeticc provides GPS fleet and vehicle tracking for businesses and vehicle owners. Our platform includes live maps, route history, alerts, reports, team access, and device management across web and mobile apps. You must use the Services lawfully and in line with these Terms and applicable privacy and employment laws in your jurisdiction.

1. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you use the Services on behalf of a company or organization, you represent that you have authority to bind that entity. Signing up, logging in, or continuing to use Fleeticc after we publish updated Terms constitutes acceptance of the current version.

2. Service Description

Fleeticc connects installed GPS hardware to our cloud platform so you can monitor vehicles and fleets in near real time. Depending on your plan and device capabilities, the Services may include location tracking, historical playback, speed and status alerts, fuel-related reporting where configured, delegated sub-user access, and related fleet management tools.

We may add, change, or discontinue features over time. We will use reasonable efforts to keep core tracking and account features available, but we do not guarantee uninterrupted or error-free operation at all times.

3. Account Registration and Security

To use most features, you must register for an account with accurate and current information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@fleeticc.com if you suspect unauthorized access.

Fleeticc uses email verification during signup and may require additional verification steps (including one-time codes sent to your email) to protect account access. You agree to keep your registered email address valid and accessible for security and service communications.

Optional two-factor authentication may be available for owner accounts. We recommend enabling it where offered. Session and device controls help limit abuse; you may be signed out when sessions expire or are revoked for security reasons.

4. Subscription and Payment

Paid plans, device subscriptions, and related fees are billed according to the pricing and payment terms presented at purchase or renewal. Unless stated otherwise in your order or our Refund Policy:

  • Subscription fees are typically billed in advance on a recurring basis (for example annually).
  • You are responsible for applicable taxes, duties, and payment processing charges.
  • We may update pricing on renewal with reasonable notice where required by law or contract.
  • Failure to pay may result in suspension or termination of access to paid features.

5. Your Responsibilities

You agree to use the Services only for lawful purposes. In particular, you are responsible for:

  • Complying with all laws that apply to vehicle tracking, fleet management, and employee or driver monitoring in your country and region.
  • Obtaining any required notice, consent, or legal basis before tracking drivers, employees, or other individuals in vehicles you monitor.
  • Installing and maintaining GPS devices correctly and only on vehicles or assets you own or are authorized to track.
  • Ensuring vehicle, device, and account information you provide is accurate.
  • Managing sub-users and shared access appropriately within your organization.
  • Using tracked vehicles lawfully and in line with local road, privacy, and fleet rules that apply to you, including in Sri Lanka, where GPS tracking services follow standard telecom and vehicle-monitoring requirements.

6. Prohibited Uses

You may not:

  • Use the Services for any illegal purpose or in violation of applicable law.
  • Track a person, vehicle, or asset without proper consent or legal authority, including covert or unauthorized surveillance.
  • Copy, scrape, reverse engineer, or attempt to circumvent Fleeticc authentication, rate limits, or security controls.
  • Send automated or abusive requests that degrade the platform for other users.
  • Resell, sublicense, or transfer access except as expressly permitted by Fleeticc.
  • Interfere with the integrity, availability, or performance of the Services.
  • Use the Services to harass, abuse, or harm any person or entity.

7. Intellectual Property

Fleeticc and its licensors own the Services, software, branding, documentation, and related materials. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose while your account is in good standing and these Terms apply.

You retain ownership of data you submit (such as vehicle names and account details). You grant Fleeticc the rights needed to host, process, and display that data solely to operate and improve the Services as described in our Privacy Policy.

8. Data, Privacy, and Cookies

Our collection, use, retention, and sharing of personal data and GPS telemetry is described in our Privacy Policy. Key points relevant to your use of the Services:

  • We do not sell your personal information to third parties.
  • GPS position history is kept for up to one hundred eighty (180) days for playback and reports, as described in our Privacy Policy.
  • You may request a portable export of your account data from your Fleeticc account settings on the website.
  • Account deletion is available on request by email; self-service automated deletion is not yet available in the apps.
  • Our website uses essential cookies for sign-in and security. Non-essential analytics and marketing cookies load only if you choose "Accept all" on the cookie banner.

9. Security

Fleeticc applies technical and organisational measures to protect the platform, including TLS encryption in transit, secure password hashing, session controls, rate limiting, and monitored infrastructure. No online service can guarantee absolute security; you share responsibility for protecting your credentials and devices.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE FULLEST EXTENT PERMITTED BY LAW. FLEETICC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, OR ERROR-FREE OPERATION, OR THAT GPS OR NETWORK CONDITIONS WILL ALWAYS PRODUCE ACCURATE OR COMPLETE LOCATION DATA.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEETICC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO FLEETICC FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold harmless Fleeticc and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party rights, including claims related to tracking without proper consent.

13. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, pose a security risk, or where required by law. You may stop using the Services at any time. Upon termination, your right to access the Services ends immediately. Provisions that by nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive termination.

To request closure or erasure of your account and associated data, contact support@fleeticc.com from your registered email. We handle eligible requests as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time by posting the revised version on our website. We will provide notice of material changes through the website or email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. Disputes should first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or courts in Sri Lanka as permitted by applicable law.
